1. About these terms
These terms are an agreement between you and Youth Sports Photography Network, LLC, doing business as Pro Trading Cards ("Pro Trading Cards", "we", "us"). They apply when you use our website and when you order custom trading cards from us. By placing an order you agree to them. Questions: info@protradingcards.com. Our Privacy Policy explains how we handle personal information, including your child's photo.
2. Who may order
You must be at least 18, or have a parent or guardian's permission. Orders for a child must be placed by that child's parent or guardian, or with their permission. We do not offer accounts to children.
3. Your account
You sign in with a one-time code sent to your email. Keep access to that email secure; anyone who can read it can sign in as you. We may suspend access that is misused.
4. Your photos and content
- You keep ownership of the photos and text you give us.
- What you allow us to do: use them only to make, preview, check, print, pack and deliver your order, and to provide customer service and handle disputes about it. We don't use your photos or your cards as samples, in advertising, or on social media unless you give us permission. Permission is separate from your order: you can order without giving it, it changes nothing about your cards, and you can tell us to stop.
- Your promises: you have the right to use every photo, name, logo and piece of text you submit; you are the child's parent or guardian or have their permission; and the content isn't unlawful, offensive, or someone else's without permission. That includes team, league and sponsor logos.
- We may refuse content that breaks these rules, and hold or cancel an order that contains it.
5. Orders, previews and changes
- Previews: the preview is made by the same system that prints your card, so it shows what will print. Please check spelling, stats and your photo. We print what you approve, and we may warn you when a photo looks too low in resolution to print well.
- Changes: you can edit your order until it goes into production. After that it is locked.
- Review: we may review an order before printing and contact you if something needs fixing.
6. Prices, payment and taxes
- Prices are shown at checkout and can differ by event. Payment is taken when you order, through our payment processor; we never see or store your full card number.
- Sales tax is calculated at checkout where it applies.
- Free packs are a promotion offered only at select events. Where an event offers one, it's one pack per player for that event, as the event's offer describes. Not every event includes a free pack, free packs have no cash value, and they can't be transferred.
7. Cancellations and refunds
- Before production: contact us and we will cancel the order and refund it in full, including shipping and tax.
- After production starts: cards are custom-made, so orders can't be cancelled or refunded for a change of mind.
8. Problems with your cards
- Tell us within 7 days of receiving your cards if they're defective, or differ from what you approved because of an error on our part. For cards collected at an event, the 7 days start when the cards are delivered to the event director.
- We'll review it and, at our option, reprint or replace the affected cards, give a credit, or refund the affected items.
- Not covered: cards that match what you approved, including your own typos, stats or photo choices, and a photo's quality or cropping.
9. Delivery
- Collected at the event: where an event offers it, we deliver the cards to the event director, who hands them out to players or teams. The director and anyone helping hand out will see the printed cards (see the Privacy Policy). Our delivery is complete when the cards are delivered to the director. Hand-out, and any cards not collected, are then between you and the event.
- Shipped: where offered or required, we ship to the address you give. Delivery times are estimates, and carriers can cause delays. If your parcel is lost in transit, contact us and we'll re-ship your order. Damaged cards follow section 8.
- If a team or player leaves an event before hand-out, we'll ask where to send the cards instead. Shipping charges may apply, including on a free pack.
10. Payment disputes
If you have a problem with an order, please contact us first. If you dispute a charge with your card issuer, we may give the payment processor the order records needed to respond: your order details, what you approved, and delivery and scan records.
We may also check a later order by hand before we print it — for example where there has been a chargeback on the account. We'll contact you if we need anything from you, and if we decide not to print the order we'll refund it in full.
11. Text messages
Checkout has two texting boxes. Neither is ticked for you, and you don't have to tick either in order to buy; without them, we email you.
- About your order. If you tick "Yes, text me at this number about this order", we may text the mobile number you gave about that order only.
- News about the tournament. If you tick "Also text me news about" the tournament, we may also send that number occasional messages about that tournament, such as a reminder before the order deadline. These are promotional messages.
The small print under the boxes says the first is for texts about this order only and the second adds occasional messages about the tournament, and: "Message frequency varies. Msg & data rates may apply. Reply STOP to opt out, HELP for help."
- Reply STOP to stop all texts. After that we send none to that number until it replies START, which resumes texts only for what you agreed to.
- We don't send promotional texts under the first box. We don't share mobile numbers or opt-in data with third parties for their marketing.
12. Our intellectual property
The website, the card designs and templates, and our software belong to us. The only exception is your content (section 4). You may not copy or reuse them without our written permission.
13. Limitation of liability
To the extent the law allows, if something goes wrong with an order, the most we owe you is what you paid for that order. We aren't responsible for indirect losses, such as lost time or a missed event. Nothing in these terms limits anything the law doesn't allow us to limit, including your rights as a consumer.
14. Indemnity
You agree to cover claims against us caused by content you submitted without the right to use it, or by your breaking these terms.
15. Events outside our control
We aren't responsible for delays or failures caused by things we can't reasonably control, such as weather, carrier or supplier failures, outages, or government action.
16. Governing law and disputes
These terms are governed by the laws of the State of Colorado. Please contact us first at info@protradingcards.com so we can try to resolve any problem. Disputes go to the state or federal courts in Arapahoe County, Colorado. Small-claims court stays available.
17. Changes to these terms
We may update these terms. The version in force when you place an order applies to that order. We'll show the effective date at the top.
18. General
If part of these terms can't be enforced, the rest still applies. These terms and the Privacy Policy are the whole agreement between us about the website and your orders.
